As Todd noted downstream, the problem appears to have been addressed and the Podshow listings (and RSS feeds) now carry better information.

In fact…the XML button now links to my Libsyn rss feed instead of something produced by Podshow.

It's interesting to note the following the Podshow TOS: Unless you specify otherwise, any and all works of authorship copyrightable by you and posted by you to your member pages (“Member Works”) are submitted with the understanding that you permit anyone to copy, distribute, display and perform your Member Works, royalty-free, on the condition that they credit your authorship each time they do so. You also permit others to distribute derivative works of your Member Works, provided that they give you proper attribution as described below. and When publicly displaying, publicly performing, reproducing or distributing copies of your Member Works, PodShow will make best efforts to credit your authorship. You grant PodShow permission to use your name for such attribution purposes. You, likewise, agree to represent yourself accurately. You acknowledge that misrepresentation may lead us, in our sole discretion, to cancel your PodShow Membership and delete any of your Member Works. and You agree that you will not knowingly and with intent to defraud provide material and misleading false information. I've not joined, but I did send them a nice note requesting access to update my feed so it accurately reflects my ownership of my show and points people to my website. We'll see what happens.

Just a thought to share. There is a Copyright field in the RSS Feed. I am no lawer but Is it not possible to fill it in with a permission statement like this: "Copyright 2006, YourWebsite.com, All Rights Researved, No Modification of this Feed is allowed without written permission by YourWebsite.com." So if this is done and someone wants to use your feed that is ok but if they want to modifiy it they need to get permission from you in writing to do so. Again I am no lawyer. These are just my thoughts. Lane

Can you not distribute your feed under a Creative Commons license as you do your show? It would seem, after using Creative Commons for the basis of a lawsuit, some of the more public figures at Podshow would respect such a declaration. Just a thought.

Just want to add my voice in support. What Podshow are doing is cheap. As you point out, it is clearly deliberate and there can be no later recourse to excuses of the type ‘Oh gee, sorry, we didn’t realize you would all be so upset’.

They are pushing the boundaries to see what they can get away with. They have effectively made a pseudo ‘channel’ out of other people’s content, without seeking the permission of the content creators. Good on you for taking the time to highlight this.

As for the person who sent you that email, I’d like to his/her definition of ‘rights’.
