Just because you Podcast does not exempt you from Libel

Posted by geeknews at 1:35 AM on August 16, 2007

One thing about podcasting, there is a fine line between opinion and libel. How you say something about someone can have very significant consequences. Some Podcasters think that their microphone is going to protect them from a libel suit.

In my book on podcasting I spent some time talking about the ways one can usually keep him or herself out of trouble. But recently I have been listening to a particular podcast that was brought to my attention that could land that podcaster in the middle of a libel suit.

Podcasters would be wise to spend a little time looking over some basic Journalism rules and learn that their actions and commentary could land them in a court of law and cost them a pile of money to defend those words.

    Come on Todd, dish! ;-)

This is why I usually add “Please Don’t Sue Me!” at the end of my podcast. hehe

Add me to the list of people probably growing fatiqued by the veiled comments. If you’re gonna gripe, name names.

Even more importantly, if we actually read/listen to the supposedly libelous stuff we might actually learn what not to say. :-)

I am a redbar radio fan. How is your wife? Shoko? Is she Japanese? I hope she dies. Hey you piece of mayan feces Todd Cochrane? Hey get my IP address and cause me lots of trouble you fag. Call and say your sorry to Redbarradio, and RBR fans, give Mike D. a special award and I will consider forgiving you. Bah, kill yourself.

I know you are refering to red bar radio in this post. I know you won’t post this comment on your blog, or you will do it to prove that statement false. What I’m here to say is who or what gives you the right to control what another human being does or acts? As far as I’m concerned podcasting is about the expression of ones self. As someone who has written a book about podcasting, I would expect for that to be a motivator for people to do podcast. But what you sir are doing is making vague accusations which are un-meritable, if you have a problem with someone go ahead and call them out. Be a man about things, if you have a problem with someone’s comments, confront them and if that leads to a arguement so be it. Not everyone likes you, and your going to have to realize this. I’m sure you been bullied your whole life and in turn you had to build a name for yourself to give you a sense of power. But that doesn’t make you a man. I feel sorry for you and I hope you can realize that you don’t have the right to control another human being because their opinion of you is not what you like.
