Apple iTunes violating copyright laws?

I had a listener of my show complain that he was having a hard time navigating my Podcast, because I had the full name of the show in the ID3 Tags, and I replied that no I did not. Well it appears if you use iTunes to actually download podcast, iTunes is changing the pre-written ID3 tag title to what is in the title of the Blog post. As I go back through some of my notes, I guess I knew this but had kinda forgotten about it. As one listener pointed out the iTunes Podcast Submission agreement even indicates they will be doing this, and the question I have to ask it why.

So instead of having "GNC-2006-03-14 #155" which I entered into the ID3 tag manually, listeners are seeing "Geek News Central Podcast 2006-03-14 #155" which is the blog post title. This in my opinion is a clear copyright violation as Apple is changing the contents of my creative works! But seeing that somewhere in the user agreement, I and thousands of others agreed to it! But the question needs to be asked is it the right thing to do?

Apple why are you doing this. Do you change music artist ID3 tags for them to suit your needs. When using Juice (which doesn't loose episodes by the way), it leaves my ID3 tags in tact and does not change them.

For the record because of the continued weird way iTunes just stops downloading podcast and how people loose shows etc. I am still recommending Juice for the podcast listener that wants to be guaranteed not to miss a download.

Actually, from what I know they have been doing this since day 1. I don't know which tags they change, but I know they change the title and shownotes. The shownotes are filled with the content of the post.

I have mixed feelings on this. I don't want them to change my show, but on the otherhand, the shownotes are nice once in a while. The problem I have with the other podcatchers is that they don't auto delete after I have listened to a show.

I forgot the mention, the title field is filled in with the post title.

They do this because it makes it easier for the standard stupid user to know which show they are picking. It's not like they didn't tell you this would happen, I read it in the Tunes Podcasting FAQ/Agreement/Whatever when it first came out.

The only reason I use iTunes is because it collects all the podcasts neatly on the Podcast menu item (which I have promoted to the top level) on my Nano. If someone could recommend another client that does the same thing, I would gladly switch.

I mostly use a playlist now. I set the order by date added and filter out those that I don't want to immedaitely listen to (like podiobooks). I also don't use the Apple URLs, I manually add most of the feeds and have not had a problem missing any shows.

Apple does this to make sure that their end user experience is as good as possible - and yes, it is a violation. They not only replace the ID3 tags with the information from your feed, they also _rename_ your file. (BTW, by doing this they remove my web site's address from my files).

The problem is all of the podcasters that don't name their files well and don't fill in the ID3 tags. And it's not just the "indies" - CBS's podcasts are all named "audioxxx.mp3" and have no tags. For someone that subscribes through a program other than iTunes, its very frustrating to find them on my player.

Although a clear violation in my mind, I think rather than try to beat Apple over the head with (what now seems to be) a toothless Creative Commons license the community should reach out and try to educate the content creators - all of the content creators, including "big media".
