The headline figure, based on the survey of over 1000 people between 16 and 65, is that the average spend per annum on CDs or vinyl was £75 (GBP) for file-sharers compared with only £51 for all surveyed.</p>
<p>The notion that illegal downloaders actually spend more money on music has always had its supporters but it’s good to see that this can now be backed up with some hard data, at least for the UK. However, there’s some much more juicy information, but remember that this is representative sample of the online population, not the whole population and not just music aficionados or games players.</p>
<p>69% of those questioned had used official or legal sources for music such as iTunes or YouTube. Physical media still dominates purchasing with 65% having bought CDs or vinyl against 33% who purchased downloadable music.</p>
<p>A third had used peer-to-peer technology or search engines to find free music but only 9% actually confessed to illegal downloading. Almost everyone knew that sharing purchased music was not &#8220;fair use&#8221; but 81% of people who had purchased their music thought that &#8220;fair use&#8221; should include the ability to move the music between different players easily.</p>
<p>47% would be interested in a monthly subscription service with the optimum price point being £5 per month but it would have to be simple and convenient to use.</p>
<p>There is only a slight male bias of 57%:43% in illegal music downloading (which is far less than I would have expected) and 46% gave &#8220;because I can&#8221; as a reason for doing it. (I think in the old days, this would’ve been known as &#8220;troughing&#8221;).  Unsurprisingly, two thirds of this group also engaged in the illegal downloading of movies, games and other software.</p>
<p>The full &#8220;Digital Music Survey&#8221; is available to download from the Demos website and it&#8217;s a fascinating read into the state of music consumption.  Recommended.</p>

Negotiations on the controversial Anti-Counterfeiting Trade Agreement start today in Seoul and some of the details of the treaty are starting to leak.</p>
<p>This treaty is Hollywood&#8217;s dream come true. Countries that sign the treaty would require each country to have DMCA type provisions that include some pretty incredible language.</p>
<p>It would require Internet users be barred from the Internet in a universal 3 strikes rule. It would require that ISP&#8217;s Police their users for copyright violations and to include user-generated content. It would include worldwide rules preventing DRM circumvention. ISP&#8217;s would have to adopt US style take-down notices.</p>
<p>This is not a trade agreement it is a gift to the entertainment industry. One things for sure it was a industry hack that wrote these provisions.  It is not surprising they want to stifle user-generated content and regain control of the vast media distribution system they once controlled but have pilfered.</p>
<p>The folks over at<a href="http://www.boingboing.net/2009/11/03/secret-copyright-tre.html"> Boing Boing</a> and <a href="http://www.eff.org/deeplinks/2009/11/leaked-acta-internet-provisions-three-strikes-and-">EFF</a> use much stronger language than I do but this secret treaty is not good for the signing countries citizens and the overall freedom of speech which we have on the Internet today.</p>
<p>An <a href="http://www.pcworld.com/article/181312/">Article at PCWorld</a> sums it up nicely &#8220;ISPs around the world will be forced to snoop on their subscribers and cut them off if they are found to have shared copyright-protected music on the Internet, under an international agreement being promoted by the U.S.&#8221;</p>

I won&#8217;t mention the site since it would defeat the purpose of this post because I don&#8217;t want the data seen either. I see things like this all the time and not just online. some group decides that a website has content that may not be suitable for, well, anyone. So they make a big deal and get lots of publicity. Guess what happens then? The website blows up since the word is out. By complaining about content these groups draw attention to the very thing they don&#8217;t want anyone else to see. Some obscure site that 500 people may stumble across turns viral and 100,000 people see it. The same thing happens with CD&#8217;s (these things are what music used to be played on). Some group decides that society cannot survive the release of a violent or sex laden music CD so they boycott Walmart and make a bunch of noise. All this does is create interest in the very thing they wish to oppose. When I was in school I remember a couple of rap albums that got all kinds of criticism for their content. Ice Tea &#038; The 2 Live Crew was constantly in the news. I actually bought the Ice Tea cassette (square thing with rolled up film like tape that played music). I probably never would have known who Ice Tea was if not for the helpful protesters.  So if you want something to be silenced then keep your own mouth closed.</p>
<p>I believe in the First Amendment whole heartedly. I know that in order for my speech to be free I have to give that right to others. Popular speech does not need protecting. Unpopular speech does. I can choose to not listen to things I don&#8217;t like or stay away from people who say things that I find awful.</p>

<p>I have been advocating for a long time that people start picking up the phone and writing to there congressional delegates and express how they fell about all of the ongoing issues that the RIAA are pushing that will limit your fair use rights even further.</p>

With the goal of destroying the user base by getting people banned for copyright infringement.</p>
<p>I have a feeling we have not heard the last from this guy. But there are some valid points by both YouTube and the user. YouTube is trying to keep from getting sued by the MPAA and various other organizations, while at the same times users are trying to express themselves through capturing important video events and posting them. <p>The recent Supreme Court decision handed down on Grokster may end up being their deciding factor depending on how the judge interperts the higher court ruling. The MPAA has been getting sites taken down with their broad interpertation of that same ruling. We shall see where this leads but it is a good battle. According to the linked article all of the functions you normally have now with your DVR can be duplicated at the head end. This is a interesting development and could be the basis of the ultimate paradigm in that we could go to content on demand for everything we watch.</p>
<p>&#8220;The technology for what Cablevision calls its &#8220;remote storage digital video recorder&#8221; (RS-DVR) &#8220;is here today, and in Cablevision&#8217;s case, we can use it to put DVR functionality in more than 2 million digital cable homes instantaneously, without ever rolling a truck or swapping out a set-top box,&#8221; COO Tom Rutledge says in a statement.&#8221;</p>

Welcome to the party my friend, and you better do more than threaten a boycott you better put your money where your mouth is and support the EFF and other organizations who are positioned to take on this battle.</p>
<p>I have not went through the authors archives, but he seems shocked by some of the language he is seeing being proposed that will remove your fair use rights through equipment attrition, well have you heard about the Analog Hole bill and the rest of the very damning legislation that is on the move. <p>Sony I am also am placing a five year ban on buying any of your electronic components and music. The Sony Laptop that needs repair will be fixed and given to charity. My wife is Japanese so she is not going to be happy about this but I am not going to buy your products plain and simple.</p>
<p>Your failure to step up and reveal to the world that you have done wrong is without comprehension, I am going to show you how pissed I am with my wallet. For five years I will not buy any of your signed artist music, any company that tries such actions such as Sony will also incur my five year ban on buying any of your products. <p>&#8220;Under a new proposed Analog Hole bill, it will be illegal to make anything capable of digitizing video unless it either has all its outputs approved by the Hollywood studios, or is closed-source, proprietary and tamper-resistant. The idea is to make it impossible to create an MPEG from a video signal unless Hollywood approves it. &#8221;</p>
<p>The details of what the want are beyond shocking they are Anti American, Anti Business, Anti Technology and all about control. The MPAA wants to control you, what you watch, what you record and what you backup in such a controlled way that the American public will likely have to spend billions of dollars to access and copy materials they have already paid for.</p>
<p>I agree with the BoingBoing article that any legislature that moves on this is an idiot. Only a lawyer firms who are getting paid millions by the MPAA could have thought up this monster. [<a href="http://www.boingboing.net/2005/11/01/hollywood_after_the_.html">BoingBoing</a>]</p>

Recently he has built a tool that allows people to bypass the DRM that Apple invokes on any media purchased through the iTunes music store.</p>
<p>Seeing how pissed off the DVD and Movie industry was and how nasty the MPAA and RIAA have been towards people of his stature I am sure he is a bit nervous. Now I would imagine a lawyer has looked at his legal standings and feel confident about him not being prosecuted here in the States but I would not be surprised if they try to pin something on him anyway.</p>
