The London-based think tank Demos has concluded that illegal downloaders spend more money on music. The headline figure, based on the survey of over 1000 people between 16 and 65, is that the average spend per annum on CDs or vinyl was £75 (GBP) for file-sharers compared with only £51 for all surveyed.

The notion that illegal downloaders actually spend more money on music has always had its supporters but it’s good to see that this can now be backed up with some hard data, at least for the UK. However, there’s some much more juicy information, but remember that this is representative sample of the online population, not the whole population and not just music aficionados or games players.

69% of those questioned had used official or legal sources for music such as iTunes or YouTube. Physical media still dominates purchasing with 65% having bought CDs or vinyl against 33% who purchased downloadable music.

A third had used peer-to-peer technology or search engines to find free music but only 9% actually confessed to illegal downloading. Almost everyone knew that sharing purchased music was not “fair use” but 81% of people who had purchased their music thought that “fair use” should include the ability to move the music between different players easily.

47% would be interested in a monthly subscription service with the optimum price point being £5 per month but it would have to be simple and convenient to use.

There is only a slight male bias of 57%:43% in illegal music downloading (which is far less than I would have expected) and 46% gave “because I can” as a reason for doing it. (I think in the old days, this would’ve been known as “troughing”).  Unsurprisingly, two thirds of this group also engaged in the illegal downloading of movies, games and other software.

The full “Digital Music Survey” is available to download from the Demos website and it’s a fascinating read into the state of music consumption.  Recommended.

Note for readers – as far as I’m aware and I’m not a lawyer, the UK does not currently have a “fair use” provision in its copyright legislation.

You are not going to believe what you are about to read. Negotiations on the controversial Anti-Counterfeiting Trade Agreement start today in Seoul and some of the details of the treaty are starting to leak.

This treaty is Hollywood’s dream come true. Countries that sign the treaty would require each country to have DMCA type provisions that include some pretty incredible language.

It would require Internet users be barred from the Internet in a universal 3 strikes rule. It would require that ISP’s Police their users for copyright violations and to include user-generated content. It would include worldwide rules preventing DRM circumvention. ISP’s would have to adopt US style take-down notices.

This is not a trade agreement it is a gift to the entertainment industry. One things for sure it was a industry hack that wrote these provisions.  It is not surprising they want to stifle user-generated content and regain control of the vast media distribution system they once controlled but have pilfered.

The folks over at Boing Boing and EFF use much stronger language than I do but this secret treaty is not good for the signing countries citizens and the overall freedom of speech which we have on the Internet today.

An Article at PCWorld sums it up nicely “ISPs around the world will be forced to snoop on their subscribers and cut them off if they are found to have shared copyright-protected music on the Internet, under an international agreement being promoted by the U.S.”

I was reading a story about a bit torrent site concerning some data that some people did not want made public. I won’t mention the site since it would defeat the purpose of this post because I don’t want the data seen either. I see things like this all the time and not just online. some group decides that a website has content that may not be suitable for, well, anyone. So they make a big deal and get lots of publicity. Guess what happens then? The website blows up since the word is out. By complaining about content these groups draw attention to the very thing they don’t want anyone else to see. Some obscure site that 500 people may stumble across turns viral and 100,000 people see it. The same thing happens with CD’s (these things are what music used to be played on). Some group decides that society cannot survive the release of a violent or sex laden music CD so they boycott Walmart and make a bunch of noise. All this does is create interest in the very thing they wish to oppose. When I was in school I remember a couple of rap albums that got all kinds of criticism for their content. Ice Tea & The 2 Live Crew was constantly in the news. I actually bought the Ice Tea cassette (square thing with rolled up film like tape that played music). I probably never would have known who Ice Tea was if not for the helpful protesters. So if you want something to be silenced then keep your own mouth closed.

I believe in the First Amendment whole heartedly. I know that in order for my speech to be free I have to give that right to others. Popular speech does not need protecting. Unpopular speech does. I can choose to not listen to things I don’t like or stay away from people who say things that I find awful.

One thing for sure based on your email your all a bunch of geeks. I guess thats why you listen to the show. I talk a little about Ohana tonight you will not want to miss.

BackupHDDVD, a tool to decrypt AACS protected movies has been released. This is for serious geeks only at this point. But needless to say this is going to cause some conversation. [doom9.org]

I just read a interview with some of the folks at the RIAA and like normal they seem to be pretty happy with themselves for suing thousands of people each year. They are also very happy with the way their lobby effort in congress has paid off.

I have been advocating for a long time that people start picking up the phone and writing to there congressional delegates and express how they fell about all of the ongoing issues that the RIAA are pushing that will limit your fair use rights even further.

Until enough people vote with their wallet their is not much we can do but watch them systematically chip away at the digital world. [CNET]

Well it’s funny that the RIAA is saying that it is now legal to RIP your CD’s onto your MP3 players. Don’t they realize that the entire world has been ripping CD’s onto MP3 players for a long time. These fools are just showing how stupid they really are. They actually asked the government to change the copyright rules. This is so beyond ridiculous that I am sure all of you are just shaking your head. [TechDirt]

Seems a Banned YouTube user is not happy with some decisions that have come down against him, in posting content that YouTube said violated copyright, while the banned user said the Videos were covered on Fair Use. He says he is going to start looking everyday at content and will go after top posters of content that have questionable content. With the goal of destroying the user base by getting people banned for copyright infringement.

I have a feeling we have not heard the last from this guy. But there are some valid points by both YouTube and the user. YouTube is trying to keep from getting sued by the MPAA and various other organizations, while at the same times users are trying to express themselves through capturing important video events and posting them. Seems Congress has some more legislation in the pipeline that is going to effect your fair use rights. The recording home coalition says:

PERFORM Act, S. 2644 would prevent satellite radio subscribers from recording and listening to programming that they have paid for – you could not choose the artists and playback order for anything you have recorded for your own, personal use! This bill, sponsored by Senators Feinstein (D-CA), Graham (R-SC) and Majority Leader Frist (R-TN), might be introduced in the House as well. It is yet another attempt by the music industry to deny consumers access to new technologies and content, and to eliminate the right to private, noncommercial home recording that citizens have enjoyed for decades.

This nonsense has to end now and the only way it will end is if you stand up on your chair beat the drum of outrage, and call your Senator tell her or him what you think. Fax your strong opinion and make sure your voice is heard. If you do not exercise your rights as Citizens of this great country then don’t be surprised with what you end up with! [TAKE ACTION TODAY]

TorrentSpy a torrent search engine who is in takedown war with the MPAA is not laying down, they are fighting back and I think they have a pretty good chance of getting the case dismissed. TorrentSpy is nothing more than a Torrent Search engine. They don’t create torrents they only track them. If you read the motion you will understand that they have some legal precedence on this one and are likening themselves to Google.

The recent Supreme Court decision handed down on Grokster may end up being their deciding factor depending on how the judge interperts the higher court ruling. The MPAA has been getting sites taken down with their broad interpertation of that same ruling. We shall see where this leads but it is a good battle. [Neowin]

Cablevision Systems is set to unveil a test that will allow consumers to time shift TV programming with their regular set top boxes. Instead of having a DVR in the home, you will now be able to use the Cable Companies infrastructure as your DVR. According to the linked article all of the functions you normally have now with your DVR can be duplicated at the head end. This is a interesting development and could be the basis of the ultimate paradigm in that we could go to content on demand for everything we watch.

“The technology for what Cablevision calls its “remote storage digital video recorder” (RS-DVR) “is here today, and in Cablevision’s case, we can use it to put DVR functionality in more than 2 million digital cable homes instantaneously, without ever rolling a truck or swapping out a set-top box,” COO Tom Rutledge says in a statement.”

If they don’t get sued by the networks this could potentially be a win for those of us concerned about Fair Use. [USA Today]

I have been on the Fair Use bandwagon for a long time, I have also been warning all of you for four years about the on going push by the MPAA & RIAA to take away your Fair Use rights, so I had to laugh when I read a article today from another technology writer that seems to have just woken up and realized their is a real threat out there. Welcome to the party my friend, and you better do more than threaten a boycott you better put your money where your mouth is and support the EFF and other organizations who are positioned to take on this battle.

I have not went through the authors archives, but he seems shocked by some of the language he is seeing being proposed that will remove your fair use rights through equipment attrition, well have you heard about the Analog Hole bill and the rest of the very damning legislation that is on the move. The Top 10 Sources website has caused a bit of a controversy in the way they are parsing multiple RSS feeds together, and John Palfrey one of the main people behind Top 10 Sources has written a lengthy piece on the matter. I have been protecting my RSS feed for a long time, but I also am smart enough to realize the power in aggregating content some don’t quite see it that way. Great read non the less. [John Palfrey]

Today is the last day to submit proposals (by 5p EST) to the Copyright Office seeking a 3-year DMCA exemption for noninfringing activities that are otherwise squelched by “digital rights management” (DRM) restrictions [EFF]

This without saying it convinces me to never every buy another CD from Sony ever again. I love music and buy Albums of groups that I like. But until their is some law on the books that prevent companies from installing spyware, rootkits and any other DRM technology I am not buying another CD.

Sony I am also am placing a five year ban on buying any of your electronic components and music. The Sony Laptop that needs repair will be fixed and given to charity. My wife is Japanese so she is not going to be happy about this but I am not going to buy your products plain and simple.

Your failure to step up and reveal to the world that you have done wrong is without comprehension, I am going to show you how pissed I am with my wallet. For five years I will not buy any of your signed artist music, any company that tries such actions such as Sony will also incur my five year ban on buying any of your products. I hate to say it but here we go again. Hollywood has fielded some new legislation that makes the broadcast flag initiative look insignificant. From BoingBoing I read the following and my jaw hit the floor

“Under a new proposed Analog Hole bill, it will be illegal to make anything capable of digitizing video unless it either has all its outputs approved by the Hollywood studios, or is closed-source, proprietary and tamper-resistant. The idea is to make it impossible to create an MPEG from a video signal unless Hollywood approves it. ”

The details of what the want are beyond shocking they are Anti American, Anti Business, Anti Technology and all about control. The MPAA wants to control you, what you watch, what you record and what you backup in such a controlled way that the American public will likely have to spend billions of dollars to access and copy materials they have already paid for.

I agree with the BoingBoing article that any legislature that moves on this is an idiot. Only a lawyer firms who are getting paid millions by the MPAA could have thought up this monster. [BoingBoing]

You all remember DVD Jon right, he was the brilliant 16 year old that built a tool the rest of the world could use to RIP DVD’s. If you remember he was acquitted twice in Norway. Well this brave soul has taken a job in San Diego so the question is now will authorities try to go after him. Recently he has built a tool that allows people to bypass the DRM that Apple invokes on any media purchased through the iTunes music store.

Seeing how pissed off the DVD and Movie industry was and how nasty the MPAA and RIAA have been towards people of his stature I am sure he is a bit nervous. Now I would imagine a lawyer has looked at his legal standings and feel confident about him not being prosecuted here in the States but I would not be surprised if they try to pin something on him anyway.

But he has said he will not be producing any tools while working in the states. [Wired]

I found some information tonight that made my mouth fall open in disbelief. I have been hammering away at you folks for a while on Fair Use and talking about the evils of the DMCA. Little did I realize the extent to which companies are pushing agendas forward to take us back to the stone ages.
